本协议的范围：本协议是您与潮自拍公司及其相关服务可能存在运营关联公司（“关联公司”）之间关于您使用潮自拍所订立的协议。本协议的内容同时还包括与。我们可能根据自身对商业、法律与政策等要素的判断，随时更新本协议；未经您明确同意，我们不会削减您按照本协议享有的合法权利。
用户个人信息保护：保护您的用户个人信息是潮自拍公司及其关联公司的一项基本原则。潮自拍公司及其关联公司将按照《中华人民共和国个人信息保护法》等相关法律法规、个人信息保护标准、本协议及《潮自拍个人信息保护政策》的规定收集、使用、存储、管理和保护您的用户个人信息；若您对《潮自拍个人信息保护政策》全部或者部分条款或者有疑问的，您可根据首部联系方式与我们联系。
美图账号与安全：为更好地使用潮自拍，您可自行注册美图账号或者在使用其他方式登录情况下随机生成美图账号；关于您使用美图账号的具体规则，请遵守《美图账号规则》规定。请您在获得美图账号后自行妥善保管账号及密码或者其他登录方式下的账号及密码；因您保管不善可能导致美图账号与密码失窃、账号被盗用等情况，将使您的权益受损。您可根据《美图账号规则》规定随时终止您的账号，潮自拍公司也将根据《美图账号规则》规定管理您的账号。
用户使用方式：您应当合理合法的使用潮自拍。除非另有约定，您在潮自拍使用、保存、浏览、分享及其他内容,均不能用于商业性用途,且权利人声明不得转发的,不可转发。
功能和服务：潮自拍为您提供多种个性化的图像工具，其中包括美颜、滤镜、证件照等。您在使用上述功能时，您应当知晓以下注意事项：
（1）当您在使用潮自拍中的证件照服务时（非证件照设计），该服务另有单独的《美图/美老师证件照用户协议》、《美图证件照个人信息保护政策》等（以下统称为“单独协议”），您在使用该项服务前请认真仔细阅读相关的单独协议并选择是否接受该协议，如您选择接受的，您应当遵守相关规则，若您对相关单独协议的全部或者部分条款有疑问的，您可根据首部联系方式与我们联系。
用户内容发布规范：您应对使用潮自拍发布的用户内容的真实性、合法性负责。如需获得该信息内容权利人或任何有权第三方（包括但不限于其他网络平台等，以下统称“授权方”）的事先授权或批准的，应事先获得该等授权或批准；您应当严格遵守本规范，不得直接或间接发布如下信息：

(1) 危害国家及社会安全信息，其表现可能包括但不限于反对宪法所确定的基本原则；危害国家安全，泄露国家机密，颠覆国家政权，破坏国家统一；煽动民族仇恨、民族歧视，破坏民族团结；破坏国家宗教政策，宣扬邪教和封建迷信；散布谣言，扰乱社会秩序，破坏社会稳定；宣扬赌博、暴力、凶杀、恐怖或者教唆犯罪；煽动非法集会、结社、游行、示威、聚众扰乱社会秩序；含有法律、行政法规和国家规定禁止的其他内容。

(2) 不安全信息，其表现可能包括但不限于含钓鱼网站链接的相关内容；含木马或其他病毒网站链接及相关内容；含潜在危险、窃取用户隐私等相关内容；影响用户体验或被大量用户举报的未经审核的外链、二维码及其他多媒体等内容。

(3) 垃圾营销信息，其表现可能包括但不限于从事买卖粉丝及相关业务；从事刷评论、刷转发、刷双井号话题词、刷搜索、刷投票、刷有奖活动业务；通过机器或软件等非人力手段对他人页面大量发送广告信息；机器抓取发送的无意义内容、重复内容；利用系统漏洞干扰潮自拍正常秩序（如盗用其他用户账号、强制其他用户关注等）；影响用户体验或被大量用户举报的、在性质上属于推销宣传推广的营销信息。

(4) 淫秽色情信息，其表现可能包括但不限于发布淫秽、色情内容，包括但不限于招嫖、寻找一夜情、性伴侣等内容；发布以色情为目的的情色文字、情色视频、情色图画等内容；长期发布与淫秽、色情内容擦边的或具有性暗示类的内容。

(5) 侵权信息，其表现可能包括但不限于制作、发布、储存侵犯他人名誉权、肖像权、隐私权、知识产权等合法权利的内容。

(6) 不正当竞争信息，其表现可能包括但不限于发布篡改、增减、删除权利标识的内容；发布未经授权方授权的内容等。

(7) 其他违反法律法规、政策以及社会公序良俗或干扰潮自拍正常运营及侵犯任何第三方合法权益的信息。

若您违反本协议，潮自拍公司有权根据自身的判断或法律与政策的需要，自主决定并可在不预先通知您的情况下，全部或者部分地选择：（1）暂停或终止对您的软件使用许可并停止相应技术服务，采取包括但不限于限制、冻结或终止美图账号使用措施，并由您自行承担美图账号无法使用后果；（2）诉诸行政执法机构或者司法机关，以追究相应法律责任。若因您违反本协议导致任何第三方损害的（含潮自拍公司及其关联公司），您应当独立承担责任；潮自拍公司及其关联公司遭受损失的，您也应当依法赔偿。

投诉举报处理：潮自拍公司倡议您共同参与维护及监督潮自拍使用环境的合规与清洁。无论是潮自拍公司主动发现用户的不当、违法行为，或者是潮自拍公司根据举报、投诉并初步查实用户存在不当、违法行为，潮自拍公司均有权立即在无事先通知的情况下采取必要的措施以制止该等行为的继续进行。
广告：潮自拍中可能包括广告，在使用潮自拍过程中您可能会接收到由潮自拍公司及其关联公司或者其第三方合作伙伴发布的广告信息。潮自拍公司及其关联公司将依照法律的规定对广告信息发布履行相关义务，如根据《广告法》对广告内容进行合法性审查。同时您应当自行判断广告信息的真实性并为自己的判断行为负责。
知识产权声明：潮自拍本身自带的所有版本、技术、程序、素材、道具和所有的信息内容（“潮自拍信息内容”，包括但不限于产品功能、人机界面、操作步骤、商标、专利、计算机软件作品等）的知识产权均归潮自拍公司、潮自拍公司许可方或潮自拍公司关联公司所有，潮自拍公司及其关联公司对您的软件使用许可在任何情况下均不应视为向您转让其知识产权的部分或者全部。您通过潮自拍下载、使用的任何素材及其他潮自拍信息内容，仅限您个人娱乐、学习、研究或者欣赏使用，未经潮自拍公司书面同意，不可用于任何商业用途。
您的知识产权及肖像权等：

（1）潮自拍尊重并保护您的知识产权，如他人未经您的授权修改您的作品或对您的作品进行歪曲、丑化、篡改，您可以通过司法、行政等救济途径向侵权行为人追偿，如您需要潮自拍公司的协助，潮自拍公司会尽力提供协助。

（2）潮自拍尊重并努力维护您的肖像权、名誉权等合法权益。您在使用潮自拍软件及相关服务时，如您有合理证据证明您的肖像权、名誉权等合法权益受到侵犯的，您可以通过司法、行政等救济途径向侵权行为人追偿，如您需要潮自拍公司的协助，潮自拍公司会尽力提供协助。

不可抗力及其他免责事由：潮自拍在使用过程中会受到如下不可抗力或者其他因素的影响，包括但不限于：政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障（以下统称“免责事由”）。因上述免责事由给您造成损失的，潮自拍公司在法律与政策允许的范围内免责，但若出现上述免责事由时，潮自拍公司将于第一时间在能力所及最大范围内进行修复或者及时补救。
适用法律与纠纷管辖：本用户协议适用中华人民共和国大陆地区法律。本用户协议项下争议，由被告住所地法院管辖。
定义及其他

（1）“潮自拍”是指潮自拍公司及其关联公司开发、运营、管理的一款应用软件产品，旨在为您提供本协议范围内免费、非独占和全球范围内的软件使用许可及技术服务。本协议项下的“潮自拍”根据不同的语境将可能指潮自拍移动端、潮自拍公司为潮自拍设立的独立网站或者潮自拍公司围绕潮自拍软件产品提供的相关技术服务。

（2）“潮自拍公司”指厦门美图网科技有限公司。

（3）“用户内容”指将可能包括但不限于任何使用潮自拍制作、分享或在潮自拍上发布的用户资料、文字、软件、音频、图片、视频、图表、广告以及其他资料等。

（4）“素材”指由潮自拍公司提供的已经内置于潮自拍的或者未来即将内置的包括但不限于字体、文字、特效、贴纸、边框、背景、模板、音乐等用于美化您照片与视频的相关素材与信息。

（5）“发布”是指用户将有关信息内容以记载、存储、提交、传送以及其他任何形式在平台上公开，使其自身、其他用户或不特定公众得以接收该等信息内容的整个过程或过程之一。

1.本協議的範圍：本協議是您與美圖公司及其相關服務可能存在的營運關聯公司（「關聯公司」）之間關於您使用潮自拍所訂立的協議。本協議的內容同時包括《美圖帳號規則》與《個人信息保護政策》。美圖公司及其關聯公司可能根據自身對商業、法律與政策等要素的判斷，隨時更新本協議；若您無法接受本協議未來更新版本的全部或者部分條款，可聯絡美圖公司，在您未與美圖公司溝通達成一致前，請停止使用潮自拍。

2.使用者資訊與個人資訊保護：保護您的使用者資訊與個人資訊是美圖公司及其關聯公司的基本原則。您同意，美圖公司及其關聯公司將按照本協議及《個人信息保護政策》的規定收集、使用、儲存、管理和保護您的使用者資訊與個人資訊；若您無法接受《個人信息保護政策》全部或者部分條款或者有疑問，請停止使用潮自拍，並可根據上述聯絡方式與我們聯絡。

3.美圖帳號與安全：為更好地使用潮自拍，您可自行註冊美圖帳號或者在使用其他方式登入的情況下隨機產生美圖帳號；關於您使用美圖帳號的具體規則，請遵守《美圖帳號規則》規定。請您在取得美圖帳號後自行妥善保管帳號及密碼或者其他登入方式下的帳號及密碼；因您保管不善可能導致美圖帳號與密碼失竊、帳號遭盜用等情況，責任由您自行承擔。您可根據《美圖帳號規則》規定隨時終止您的帳號，美圖公司也將根據《美圖帳號規則》規定管理您的帳號。

4.您的必要授權：您利用潮自拍拍攝或者製作的資訊內容中，所含有的智慧財產權歸您所有。因提供、優化和宣傳推廣本服務所必須，您同意授權美圖公司免費、非獨占、不可撤銷地可在全球範圍內使用您在本服務過程中產生的資訊內容。美圖將盡最大努力在合理範圍內使用上述資訊內容，且您的必要授權並不代表美圖公司必然使用上述資訊內容，也不改變您對上述資訊內容的所有權及其智慧財產權歸屬，更不影響您對上述內容資訊任何合法使用。

5.您的合法使用：您應對使用潮自拍所拍攝、製作、發布或者儲存的圖片等數位資訊的真實性、合法性負責。您不得使用潮自拍製作、儲存或發布如下資訊內容：

(1) 危害國家及社會安全的資訊，其內容可能包括但不限於反對憲法所確定的基本原則；危害國家安全、洩露國家機密、顛覆國家政權、破壞國家統一；煽動民族仇恨或民族歧視、破壞民族團結；破壞國家宗教政策、宣揚邪教和封建迷信；散布謠言、擾亂社會秩序、破壞社會穩定；宣揚賭博、暴力、凶杀、恐怖或者教唆犯罪；煽動非法集會、結社、游行、示威、聚眾擾亂社會秩序；含有法律、行政法規和國家規禁止的其他內容。
(2) 淫穢色情資訊，其內容可能包括但不限於發佈淫穢、色情內容，包括但不限於招妓、尋找一夜情、性伴侶等內容；發佈以色情為目的的情色文字、情色影片、情色圖畫等內容；長期發佈與淫穢、色情內容擦邊的或具有性暗示類的內容。
(3) 侵權資訊，其內容可能包括但不限於製作、發佈、儲存侵犯他人名譽權、肖像權、隱私權、智慧財產權等合法權利的內容。
(4) 不正當競爭資訊，其內容可能包括但不限於發佈篡改、增減、刪除權利標識的內容；發佈未經授權方授權的內容等。
(5) 其他違反法律法規、政策以及社會公序良俗或干擾潮自拍正常營運及侵犯任何協力廠商合法權益的資訊。

若您違反本協議，您同意美圖公司有權根據自身的判斷或法律與政策的需要，自主决定並可在不預先通知您的情況下，全部或者部分地選擇：（1）暫停或終止對您的軟體使用授權並停止相應技術服務，採取包括但不限於限制、凍結或終止美圖帳號使用措施，並由您自行承擔美圖帳號無法使用之後果；和（2）訴諸行政執法機構或者司法機關，以追究相應法律責任。若因您違反本協議導致任何第三方損害的（含美圖公司及其關聯公司），您應當獨立承擔責任；美圖公司及其關聯公司遭受損失的，您也應當一併賠償。

6.廣告：潮自拍中可能包括廣告，這屬於美圖公司及其關聯公司合理合法的商業模式，您同意在使用潮自拍過程中接收由美圖公司及其關聯公司或者其第三方合作夥伴發布的廣告資訊。美圖公司及其關聯公司依照法律的規定對廣告資訊發布履行相關義務後，您應當自行判斷廣告資訊的真實性並為自己的判斷行為負責，除法律明確規外，您因依據該廣告資訊進行的交易或廣告主提供的內容而遭受的損失或損害，美圖公司及其關聯公司概不負責。

7.智慧財產權聲明：潮自拍內建的所有版本、技術、程式、素材、道具和所有的資訊內容（「潮自拍資訊內容」，包括但不限於產品功能、使用者介面、操作步驟、商標、專利、電腦軟體作品等）的智慧財產權均歸美圖公司、美圖公司授權方或美圖公司關聯公司所有，美圖公司及其關聯公司對您的軟體使用授權在任何情況下均不應視為向您轉讓其部分或全部的智慧財產權。您透過潮自拍下載、使用的任何素材及其他潮自拍資訊內容，僅限您個人娛樂、學習、研究或者欣賞使用，未經美圖公司書面同意，不可用於任何商業用途。

8.不可抗力與其他免責事由：潮自拍在使用中會受到包括但不限於如下不可抗力的影響：政治原因、社會環境、自然災害、經濟危機、電腦病毒或駭客攻擊、伺服器或系統不穩定、使用者所在的特殊位置、任何技術能力、網路品質以及通訊線路、電腦故障等。（以下統稱「免責事由」）。若出現上述免責事由情況時，美圖公司將盡力在第一時間修復或者及時補救，若為您造成損失，美圖公司在法律與政策允許的範圍內免責。

9.潮自拍變更、中斷與終止：除本協議其他約定外，美圖公司及其關聯公司還有權根據自己獨立商業判斷對潮自拍內容進行變更、中斷或終止。除其他協議另有規外，美圖公司不對相應變更、中斷或終止承擔任何責任，您應妥善做好資料更新、備份與轉移工作。

10.適用法律與糾紛管轄：本協議成立、生效、履行、解釋及糾紛解决，均適用中華人民共和國大陸地區法律（不包括衝突法）。本協議簽訂地為中華人民共和國福建省廈門市思明區。若在您與美圖公司及其關聯公司之間發生的任何糾紛或爭議，您同意將該糾紛或者爭議提交本協議簽訂地有管轄權的人民法院排他管轄。本協議條款無論何種原因部分無效或不可執行，其他條款仍應繼續有效，對雙方具有約束力。

11．定義及其他

（1）「潮自拍」是指美圖公司及其關聯公司開發、營運、管理的一款應用程式軟體產品，旨在為您提供本協議範圍內免費、非獨占和全球範圍內的軟體使用授權及技術服務。本協議項下的「潮自拍」根據不同的語境將可能指潮自拍行動端、美圖公司為潮自拍設立的獨立網站或者美圖公司圍繞潮自拍軟體產品提供的相關技術服務。
（2）「美圖公司」指廈門美圖網科技有限公司。
（3）「素材」指由美圖公司提供、內建於潮自拍或者未來即將內建、用於美化您照片的相關素材與資訊，包括但不限於字體、文字、特效、貼紙、邊框、背景、模板等。

Selfiecity-Terms of Services

Thank you for using Selfiecity!

Important: Before you (also the "user") read and decide whether to accept this Selfiecity Terms of Services (the "Agreement"), Meitu advises you to carefully read and understand the provisions of this Agreement that are underlined and in bold, which exclude or limit the liability of Meitu and which place significant obligations upon the user. If you are a minor, please read and decide whether to accept this Agreement in the company of your legal guardian. If you have any questions about this Agreement, or reject this Agreement in whole or in part, or wish to provide feedback (including suggestions and complaints) to Meitu on your use of Selfiecity, you must cease using Selfiecity and may contact us via QQ at 800019025, via email at support@meitu.com/legal@meitu.com, or by phone at 0086 592 5320520.

1. Scope of this Agreement: This Agreement is made between you and Meitu and its affiliates ("affiliates") and governs your use of Selfiecity. This Agreement covers both the Meitu ID Regulations and the Privacy Policy. Meitu or its affiliates may update this Agreement at any time at their discretion for business, legal or policy reasons. If you reject all or part of any future updated version of this Agreement, you may contact Meitu and must cease using Selfiecity unless and until you reach an agreement with Meitu.

2. Protection of User Information and Personal Details: It is the policy of Meitu and its affiliates to protect your user information, including your personal details. You agree that Meitu and its affiliates will collect, use, store, manage and protect your user information, including your personal details, in accordance with this Agreement and the Privacy Policy. If you reject the Privacy Policy in whole or in part or have any questions, you must cease using Selfiecity and may contact us using the contact details provided above.

3. Meitu ID and Security: For a better Selfiecity user experience, you may choose to sign up for a Meitu ID or generate a Meitu ID by other means. Your use of your Meitu ID is subject to the Meitu ID Regulations. Please keep your Meitu ID username and password secure. You shall be liable for the theft of your username or password or any unauthorized use of your Meitu ID due to your failure to keep this information secure. You may terminate your Meitu ID at any time in accordance with the Meitu ID Regulations, and Meitu will also manage your Meitu ID in accordance with the Meitu ID Regulations.

4. Your Grant of License: You shall have the intellectual property rights to the photos taken or processed by you using Selfiecity. You agree to grant Meitu a royalty-free, non-exclusive, irrevocable, worldwide license to use the photos taken or processed by you using Selfiecity for the purposes of offering, optimizing and promoting Selfiecity. Meitu will make reasonable use of these photos, and your grant of this license does not imply the guaranteed use of these photos by Meitu, nor will it change your ownership status of these photos or your intellectual property rights thereof, nor will it affect your legal use of these photos.

5. Your Legal Use: You shall be liable for the authenticity and legitimacy of the photos taken, processed or stored by you using Selfiecity. You shall not use Selfiecity to develop, store or post the following information:

(i) Information that endangers national and social security, including but not limited to: information that opposes the basic principles established by the Constitution; information that endangers national security, leaks national secrets, subverts the national regime or undermines national unity; information that incites racial hatred or discrimination or undermines racial harmony; information that undermines national religious policies or promotes cults or superstitions; information that spreads rumors, disturbs the social order or undermines social stability, information that advocates or incites gambling, violence, murder, terrorism or any other criminal activity; information that incites an unlawful assembly, association, march or demonstration, or gathers crowds to disturb social order; or any other information prohibited by law, relevant policies and procedures or national regulations.
(ii) Obscene or pornographic information, including but not limited to information that involves soliciting prostitutes or looking for casual sex or sexual partners, etc., erotic texts, videos or pictures, or any other content of a sexually suggestive nature.
(iii) Information that infringes the rights of others, including but not limited to their legitimate rights under law, including the right to a sound reputation, the right of publicity, the right to privacy and intellectual property rights.
(iv) Information that creates unfair competition, including but not limited to altering, adding or removing proprietary content, or posting unauthorized information.
(v) Any other information that violates laws, regulations, policies or social conventions, interferes with the normal operation of Selfiecity or infringes the legitimate rights and interests of any third party.

If you violate this Agreement, you agree that Meitu may, at its discretion or as required by law and policies, and without prior notice to you, (1) suspend or terminate the software license granted to you and cease to provide technical services, and take measures including but not limited to restricting your use of your Meitu ID or freezing or terminating your Meitu ID at the risk of you being unable to use your Meitu ID; and/or (2) refer you to an administrative enforcement agency or judiciary authority to assess your legal liability. You shall be solely liable for any damage caused to any third party (including Meitu and its affiliates) as a result of your violation of this Agreement, and agree to compensate Meitu and its affiliates for any losses thus incurred.

6. Advertising: Selfiecity may contain advertisements, which are part of Meitu and its affiliates' reasonable and lawful business model. You agree to receive advertising released by Meitu and its affiliates or third-party partners while you are using Selfiecity. After Meitu and its affiliates have performed their obligations in connection with the release of advertisements according to law, you shall make your own judgment about the authenticity of such advertisements and shall be liable for your judgment. Unless otherwise stipulated by law, Meitu and its affiliates are not liable for any losses or damage incurred by you from the transactions performed based on such advertisements or the content provided by advertisers.

7. Intellectual Property Rights Notice: The intellectual property rights in all versions, technologies, programs, material, items and all information provided with Selfiecity (collectively referred to as "Selfiecity Information", including but not limited to product features, user interfaces, operating steps, trademarks, patents, computer software) shall be vested in Meitu, or Meitu's licensors or affiliates. The grant of a license to you by Meitu and its affiliates to use the software provided by Meitu shall in no event be deemed a transfer to you of all or part of the intellectual property rights therein. Any material downloaded by you from Selfiecity and any other Selfiecity information may be used by you for the purpose of your personal recreation, learning, research or appreciation only, and may not be used for any commercial purposes without the written consent of Meitu

8. Force Majeure and Other Grounds for Exemption from Liability: Your ability to use Selfiecity may be affected by the following: political factors, the social environment, natural disasters, economic crises, attacks from computer viruses or hackers, server or system instability, your location, technical limitations, network quality and failures in communication lines or computers (hereinafter collectively referred to as "grounds for exemption from liability").In the event of any of such grounds for exemption from liability, Meitu will make every endeavor to restore normal operations and thereby remove the grounds for exemption as soon as possible. During this period, Meitu shall be exempt from liability for losses incurred by you to the extent permitted by law and policies.

9. Modification, Interruption and Termination of Content within Selfiecity:Except as otherwise stipulated in this Agreement, Meitu and its affiliates shall have the right to modify, interrupt or terminate the content within Selfiecity based on their sole business judgment. Except as otherwise stipulated in any other agreement, Meitu is not liable for losses resulting from any such modifications, interruptions or terminations. It is your responsibility to update, back up and transfer data.

10. Governing Law and Dispute Resolution: This Agreement is established, enters into force, and shall be enforced and interpreted under the law of the People's Republic of China, without regard to its conflict of laws provisions. Any disputes arising hereunder shall also be resolved in accordance with the law of this jurisdiction. This Agreement is entered into in Siming District, Xiamen, Fujian Province, People's Republic of China. You agree to submit any disputes between you and Meitu or any of its affiliates to a people's court with jurisdiction in the place where this Agreement was entered into for exclusive jurisdiction. If any provision of this Agreement is held to be invalid or unenforceable for whatever reason, the remaining provisions shall remain in full force and effect and binding upon you and Meitu

11. Definitions and Miscellaneous

(i) "Selfiecity" is an app developed, operated and managed by Meitu and its affiliates that aims to provide you with a royalty-free, non-exclusive and worldwide software license and technical services. "Selfiecity" under this Agreement may refer to any mobile client of Selfiecity, the independent website set up by Meitu for Selfiecity or the technical services provided by Meitu in connection with the Selfiecity app.
(ii) "Meitu" refers to Xiamen Meitu Networks Technology Co., Ltd.
(iii) "Material" refers to material and information that have been provided by Meitu and built into Selfiecity, or that will be provided by Meitu and built into Selfiecity, and can be used to edit your photos, including but not limited to fonts, text, special effects, stickers, borders, backgrounds and templates.
