Important:

(1) Before you (referred to as the "User") start reading and decide whether to accept the Meitu Terms of Service (the "Agreement"), we advise you to carefully review the content of this document, especially sections in bold and italics.

(2) Minors under the age of 14 should carefully review this Agreement with their legal guardians and determine whether they accept it.

(3) You must read this Agreement carefully before deciding whether to accept it. If you accept this Agreement, you may begin using Meitu's features and services. Should you have any inquiries regarding this Agreement, find any terms unacceptable (in whole or in part), or need to provide feedback (including suggestions, complaints, or reports) during usage, please contact us via: Customer Service QQ: 800019025 Emails: support@meitu.com, legal@meitu.com Phone: 400-009-3360.

(4) If you want to use Meitu internationally, you may download the corresponding version from local app stores.

(5) Some features and services of Meitu are offered through third-party platforms, including Meitu Customization, Meitu Wallet, and various features or services available in the Game Center. Since this Agreement does not apply to any features or services provided by third parties, please review the relevant documents, such as their Terms of Services, if you need to access and use those products or services.

(6) The features and services offered by Meitu can differ based on the version you are using (for instance, you will not have access to features related to poster templates, recipes, and communities if you are using the Harmony OS version of Meitu).

1. This Agreement defines the terms between you and Meitu Inc., as well as its affiliates that may operate related services, regarding your use of Meitu. This Agreement also encompasses the Meitu Account Regulations, Meitu Community Management Rules, Meitu ID Photo Rights and Interests Dispute Complaint Handling Rules, and the Meitu Personal Information Protection Policy.

Meitu and its affiliates may occasionally update this Agreement based on their assessment of commercial, legal, and policy considerations. We will not diminish your legal rights under this Agreement without your explicit consent.

1. Safeguarding your personal information is a fundamental principle of Meitu Inc. and its affiliates. Meitu Inc. and its affiliates will collect, use, store, manage, and protect your personal information in accordance with the Personal Information Protection Law of the People's Republic of China and other relevant laws and regulations, personal information protection standards, this Agreement, and the Meitu Personal Information Protection Policy. If you have any questions about all or part of the Meitu Personal Information Protection Policy, you may contact us using the contact information provided in the preamble.
2. 3. To better use Meitu, you may voluntarily register a Meitu account or use a randomly generated Meitu account when logging in through other methods. Please comply with Meitu Account Regulationswhen using your Meitu account. Please keep your login credentials (or credentials for other login methods) safe after obtaining your Meitu account. Failing to do so may lead to account theft or compromises that can damage your interest. You may terminate your account during use at any time in accordance with the Meitu Account Rules. Meitu Inc. will also manage your account in accordance with the Meitu Account Rules.
3. You should use Meitu in a lawful manner. Unless stated otherwise, any pictures, videos, and other content shared or viewed on Meitu should not be used for commercial purposes. Additionally, if the original creator requests that their content not be shared, you are not permitted to do so.
4. For the AI-related services provided as part of the product, you must understand that before using the service, the content generated by AI depends on the in-depth learning of big data by artificial intelligence, and it is not ruled out that some of the information may be flawed, unreasonable or offensive. Therefore, you must ensure that you use this service to generate AI content legally, without infringing any third party's copyrights, trademarks, or other legal rights, and shall not use generated works for any illegal purposes; if your improper use causes damage to any third party's rights, you shall bear corresponding legal liabilities.
5. Meitu provides you with various personalized photo editing features, video shooting/editing functions, and image tools, including portrait beautification, Meitu templates (mobile-exclusive), image editing, poster templates, collage, cutout, ID photos, AI portrait cutout, photo restoration, professional ID photos, HD portraits, advanced acne removal, portrait noise reduction, scene noise reduction, anime style (architecture), ArtBot, and studio retouching. You should acknowledge the following considerations when using the aforementioned functions:

(1) The aforementioned functions and tools may differ depending on the version of Meitu you are using. For specific tool categories, methods of use, and instructions, please refer to the detailed descriptions on the relevant function and tool pages of each Meitu version.

(2) The intellectual property rights to the original images you upload while using Meitu's photo/video shooting, editing, AI painting, and beautification features belong to you, your licensor(s), or your affiliated entities.

(3) Regarding value-added services: Meitu Inc. and its affiliates may provide certain services, features, and tools on a fee-charging basis. If you intend to use such fee-based services, you must thoroughly review the relevant value-added service agreement and decide whether to accept its terms. Upon acceptance, you are obligated to comply with the Agreement. Should you have questions about the Agreement or its amendments, immediately cease using the Value-Added Services and contact Meitu Inc. via the contact channels specified in the Preamble. If you are a minor under 14 years of age, you must review the value-added service agreement with your legal guardian and obtain their consent before accepting the Agreement or its services.

(4) When using the Meitu ID Photo Service (excluding ID photo design functions), please note that separate governing documents apply, including the Meitu ID Photo Terms of Service, Meitu ID Photo Personal Information Protection Policy, and Meitu ID Photo Rights Dispute Resolution Protocol (collectively referred to as the "Special Agreements"). Prior to using this service, you must thoroughly review and decide whether to accept the Special Agreements. Upon acceptance, you shall abide by the relevant rules. For inquiries regarding any clauses within the Special Agreements, contact us through the channels provided in the Preamble.

(5) Meitu products may undergo version iterations or upgrades in the future. This clause does not constitute a commitment by Meitu Inc. to maintain specific functions/services, nor shall it alter the ownership and intellectual property rights of user-generated content, or impede lawful content utilization.

7. Meitu Community (or "MT Community")is a platform where users can share, access, and distribute content provided by Meitu Inc. It is integrated into the Meitu app, BeautyCam app, Wink app, and other Meitu products via API technology. As a result, any content you post in the Meitu Community will be visible in these applications.
8. User community content:Unless otherwise stipulated, ownership, intellectual property rights, and associated legal entitlements pertaining to original content published through the MT Community remain vested in you, your licensors, or affiliated entities. Meitu will enhance your content visibility and improve publishing efficiency.

(1) Your published content may be shared across platforms operated by Meitu, its affiliates, and partners, including BeautyCam, Meipai, Official WeChat Account, and Weibo. Your account nickname and author watermark will be retained. If you disagree with this sharing method or have any concerns, please contact Meitu Inc. as specified in this Agreement.

(2) Meitu has introduced a video soundtrack feature to enhance user experience and better fulfill entertainment-sharing needs. The Original Audio functionality enables community users to utilize audio tracks from your published videos as background scores for derivative works.  To disable this feature: Navigate to Settings > Privacy & Notifications and deactivate "Original Audio". Termination prohibits subsequent audio utilization by third parties. Disabling this feature will prevent other users from accessing your video soundtracks.

(3) Meitu has introduced video templates and Meitu templates to enhance user experience and better meet entertainment-sharing needs. When you use video templates or Meitu templates and choose to share them in MT Community, you can also actively check the box for "Allow others to apply my template." This allows other Meitu users to incorporate your shared lyrics, captions, background sounds, and music into their videos. They can also apply your template to create new visual content. Ensure all images and videos you upload or use are either your own creations or have been fully authorized by the rights holder, without infringing on the legitimate rights or interests of others. If you'd like to keep your template private, please avoid checking the "Allow others to apply my template" option when sharing photos or videos. Additionally, if you want to prevent others from saving your work, you can disable the "Allow others to save your pictures or videos" feature by going to Settings > Privacy and Notifications. Disabling this feature will prevent other users from downloading your pictures and videos.

(4) If your rights are infringed upon, causing damage to Meitu Inc. and its affiliates. For instance, if a third party violates the copyright of your content on Meitu, you agree to collaborate with Meitu Inc. and its affiliates. You authorize them to represent you in taking measures against any infringing third party, including issuing warnings, filing complaints, initiating or participating in administrative or legal (civil or criminal) proceedings, or negotiating settlements. You may also participate in these enforcement actions as deemed necessary by Meitu Inc. and its affiliates.

1. User code of conduct:You are responsible for the authenticity and legality of any user-generated content you publish or create using Meitu. If you need to obtain prior authorization or approval from the right-holder of the information content or any authorized third party (including but not limited to other online platforms, hereinafter collectively referred to as the "Authorized Party"), you shall not publish or create such content until you have obtained the authorization. Before using the community features of Meitu, you should read the Meitu Community Management Rules carefully and choose whether to accept them. If you choose to accept, you shall abide by the Meitu Community Management Rules and shall not directly or indirectly use Meitu to create or publish the following information or content:

(1) Information or content that endangers national and social security, which may include but is not limited to: opposing the basic principles established by the Constitution; endangering national security, disclosing state secrets, subverting state power, and undermining national unity; inciting ethnic hatred and discrimination, and undermining ethnic unity; undermining national religious policies, promoting cults and feudal superstitions; spreading rumors to disrupt social order and undermine social stability; promoting gambling, violence, homicide, terrorism, or abetting crimes; inciting illegal assemblies, associations, processions, demonstrations, and gatherings to disrupt social order; containing other content prohibited by laws, administrative regulations, and national regulations.

(2) Unsafe information or content, which may include but is not limited to: content related to phishing website links; content related to websites with Trojan horses or other viruses; content related to potential dangers and stealing user privacy; un-reviewed external links, QR codes, and other multimedia content that affects user experience or is reported by a large number of users.

(3) Spam marketing information or content, which may include but is not limited to: engaging in the business of buying and selling followers; engaging in the business of brushing comments, reposts, double-hashtag topic words, searches, votes, and prize-winning activities; sending a large number of advertising messages to others' pages through non-human means such as machines or software; meaningless and repetitive content sent by machine scraping; using system vulnerabilities to interfere with the normal operation of Meitu (such as stealing other users' accounts, forcing other users to follow, etc.); marketing information that affects user experience or is reported by a large number of users and is in nature of promotion and advertising.

(4) Obscene and pornographic information or content, which may include but is not limited to: publishing obscene and pornographic content, including but not limited to soliciting prostitution, seeking one-night stands, sexual partners, etc.; publishing pornographic texts, videos, pictures, etc. for pornographic purposes; long-term publishing of content that is on the verge of obscenity and pornography or has sexual implications.

(5) Infringing information or content, which may include but is not limited to: creating, publishing, and storing content that infringes on others' legitimate rights such as the right of reputation, the right of portrait, the right of privacy, and intellectual property rights.

(6) Unfair competition information or content, which may include but is not limited to: publishing content with tampered, added, or deleted right-related marks; publishing content without the authorization of the Authorized Party.

(7) Other information or content that violates laws, regulations, policies, and social ethics, or interferes with the normal operation of Meitu and infringes on the legitimate rights and interests of any third party.

If you do not agree with the Meitu Community Management Rules, please do not use the community features of Meitu Xiuxiu. If you violate this Agreement and/or the Meitu Community Management Rules, Meitu Inc. has the right to make an independent decision based on its own judgment or the needs of laws and policies, and may, without prior notice to you, choose either fully or partially: (1) Suspend or terminate your software usage license and stop the corresponding technical services, and take measures including but not limited to restricting, freezing, or terminating the use of your Meitu account, and you shall bear the consequences of the inability to use your Meitu account; (2) Appeal to administrative law enforcement agencies or judicial organs to pursue corresponding legal responsibilities. If your violation of this Agreement causes damage to any third party (including Meitu Inc. and its affiliates), you shall bear the liability independently; if Meitu Inc. and its affiliated companies suffer losses, you shall also compensate them in accordance with the law.

1. Complaint and reporting handling: Meitu Inc. advocates that you jointly participate in maintaining and supervising the compliance and cleanliness of the Meitu usage environment. Whether Meitu Inc. actively discovers users' improper or illegal acts, or after preliminary verification based on reports and complaints that users have committed improper or illegal acts, Meitu Inc. has the right to immediately take necessary measures to stop such acts from continuing without prior notice. The specific provisions shall be subject to the Meitu Community Management Rulesand the Meitu Rights and Interests Dispute Complaint Handling Rules.
2. Advertisements:Meitu may include advertisements, and while using the app, you may encounter promotional content from Meitu, its affiliates, or third-party partners. Meitu Inc. and its affiliates will ensure that the release of advertising information complies with the Advertising Law of the People's Republic of China and other relevant laws and regulations. At the same time, you are responsible for assessing the authenticity of the advertising information and for any decisions you make based on that assessment.
3. Declaration of intellectual property:

(1) All versions, technologies, programs, materials, props, and information that come with Meitu (referred to as "Meitu's information content") are owned by Meitu Inc., its licensors, or its affiliates. This includes, but is not limited to, product features, user interfaces, operational processes, trademarks, patents, and computer software, all of which are protected as intellectual property. The license granted to you by Meitu Inc. and its affiliates for using the software does not, under any circumstances, transfer or grant you any rights to its intellectual property.

(2) You may not modify, copy, distribute, transmit, mirror, trade, decompile, disassemble, reverse compile, reverse assemble, reverse engineer, or use any similar methods to obtain or crack the source code of Meitu in any way.

(3) Unless you and Meitu Inc. agree otherwise, any materials you download and use through Meitu, as well as other built-in content provided by Meitu, are intended solely for your personal entertainment, study, research, or appreciation. You may not use them for any commercial purposes without written consent from Meitu Inc.

(4) You may use the content generated by Meitu's AI features (referred to as "AI-generated content") as long as you comply with applicable laws and the terms of this Agreement. You will hold all rights and interests related to the creation and use of this content. However, you are fully responsible for any misuse of AI-generated content.

(5) To ensure the stable operation of Meitu's AI features and enhance product optimization, Meitu will store AI-generated content within the permitted scope as allowed by law and use it for product improvement and AI technology research.

1. Your rights regarding intellectual property and image use:

(1) Meitu respects and protects your intellectual property rights. If your work is altered, misrepresented, or misused without your permission, you can seek remedies through legal or administrative channels. Meitu will provide assistance if needed.

(2) To enhance interactive experiences, Meitu provides features that allow users to download the pictures and videos of others. Enabling these features allows other users to recreate or save your creations for future use. Meitu values your preferences. You can allow others to access your content or disable the download features by going to Settings > Privacy and Notifications. Disabling this feature will prevent other users from downloading your work.

(3) Meitu respects and is committed to protecting your legitimate rights and interests, including your rights to your image and reputation. If you use Meitu and its related services and believe that your rights to portrait, reputation, or other legitimate interests have been violated, you can seek remedies from the infringer through legal, administrative, or other means. Should you require assistance from Meitu Inc., we will do our utmost to help you.

1. Third-party services: Some features and services in Meitu, including those related to Meitu customization, the Meitu wallet, and the game center, are provided by third-party providers. You acknowledge that Meitu Inc. is the platform's service provider, while the third-party features and services are managed independently by the respective third parties, which bear full responsibility for their management. Please take the time to read the Terms of Service and any other relevant documents from third parties, and use their features and services with care. Meitu Inc. does not intervene in any disputes or conflicts of interest between you and third parties.
2. Force majeure and other exemptions:Meitu may be affected by various force majeure events or other factors. These include, but are not limited to, political issues, social conditions, natural disasters, economic crises, computer viruses or hacker attacks, server or system instability, unexpected regulatory changes, network failures, network congestion, communication line issues, and computer malfunctions (collectively referred to as "Exemptions"). If you experience any losses due to the Exemptions mentioned above, Meitu Inc. will not be held liable to the extent allowed by law and policy. However, in such cases, Meitu Inc. will make every effort to address and resolve issues promptly.
3. Governing law and jurisdiction: This Terms of Service is governed by the laws of the People's Republic of China. Any disputes under this Agreement shall fall under the jurisdiction of the court over the place where the defendant is located.
4. Definitions and additional information

(1) "Meitu" refers to a software application developed, operated and managed by Meitu Inc. and its affiliates. Its purpose is to provide users with free, non-exclusive, worldwide software licenses and technical services as outlined in this Agreement.

(2) "Meitu Inc." refers to Xiamen Hongtian Chuangshi Technology Co., Ltd. or any authorized operating company designated by Xiamen Hongtian Chuangshi Technology Co., Ltd. to manage, launch, and promote various versions of Meitu, including Xiamen Meitu.com.

(3) "User Content" refers to, but is not limited to, any information published by users, such as text, software, audio, images, videos, charts, advertisements, and other materials on Meitu.

(4) "Elements" refer to the resources and information supplied by Meitu that are currently included in or will be integrated into the app. This encompasses a variety of elements such as fonts, text, special effects, stickers, borders, backgrounds, templates, music, and other related resources used to enhance your photos and videos.

(5) "Publishing" encompasses the entire process or any part where users record, store, submit, transmit, and share information on the platform in various formats, allowing themselves, other users, or the general public to access that information.
